Terms of Service: Plein Air in the Mountains

A FADE Initiative, LLC Community Event

1. Registration and The “Official Go” Status

  • The Threshold: To ensure a vibrant community experience, each session requires a minimum of 5 participants.
  • Confirmation: Sessions are “Pending” until the 5-person threshold is met. Once met, the status updates to “Confirmed.”
  • Postponement: If the minimum is not reached 72 hours prior to the event, FADE reserves the right to postpone the session. In this event, registrants will receive a 100% refund or a full credit toward a future date.

2. Cancellation and Refund Policy

  • Self-Service Credits: Cancellations made 7 days or more prior to the event will receive a full credit toward a future session.
  • No-Show Policy: Cancellations made less than 7 days before the event, or failure to attend, are non-refundable and non-creditable.
  • Transferability: Registrations are personal to the registrant. However, because no physical materials are shipped for this event, you may gift your spot to a friend at no extra cost, provided you notify FADE via email 24 hours in advance.

3. Logistics and Physical Readiness

  • Self-Reliance: Participants are responsible for their own transportation to and from the site.
  • Physical Environment: The Cherokee National Forest is a wild environment with uneven terrain, changing weather, and limited cellular service. Participants represent that they are physically capable of navigating unpaved forest paths.
  • Food & Water: FADE provides water for hydration and painting. FADE does not provide food or snacks.

4. Environmental Stewardship (Leave No Trace)

  • Waste Disposal: To protect our National Forests, all participants must use the FADE-provided disposal containers for paint water and gray water. Dumping any foreign substance into streams or onto forest soil is strictly prohibited.
  • Compliance: Participants agree to follow all U.S. Forest Service regulations as directed by the FADE site coordinator.

5. Intellectual Property and Media

  • Self-Directed Work: All artwork created during the event remains the sole property of the artist.
  • Media Release: By attending, participants grant FADE Initiative, LLC the right to use photographs and video taken during the event for promotional and community-building purposes.

6. Liability and Safety

  • Assumption of Risk: Outdoor activities involve inherent risks (e.g., weather, insects, terrain). By registering, participants assume all risks associated with the forest environment.
  • Safety: Participants are responsible for their own medical needs (e.g., allergies, medications). FADE Initiative, LLC is not liable for personal injury or loss of personal property.

7. Weather and Force Majeure

  • Light Weather: We are an all-weather community. In the event of light rain, we will utilize on-site canopy coverage.
  • Severe Weather: In the event of extreme weather warnings or Forest Service closures, FADE will issue a 100% refund or credit.
